I Have an Active Mediator Practice, Having Successfully Mediated Over 115 Commercial Disputes

Mediation offers parties an opportunity to develop creative solutions to complex disputes in ways they may find more effective and efficient and less polarizing and expensive than traditional litigation.


The mediator must have the ability to establish good rapport and trust, demonstrate creativity, especially the ability to generate settlement options, have patience, possess a positive and optimistic attitude, have tenacity, and, sometimes, subject-matter knowledge.

Dispute over the amount owed to the estate of the deceased executive by a former employer.


Claims for deferred compensation by an equity derivatives trader and his former trading firm employer.


Claims for indemnity under a stock purchase agreement involving the sale of a subsidiary by a U.S. privately-held company to a foreign public company.


Claim by a law firm for a fee.

Mediated claims for indemnification by purchaser alleging breach of representations and warranties in a stock purchase agreement.


AAA mediation involving claims of breach of representation in a stock purchase agreement incident to the sale by a U.S. privately-held company of a subsidiary to a foreign public company.


AAA mediation involves a dispute related to the sale of a business and valuation issues.


ICDR mediation involves a dispute alleging a breach of a membership interest purchase agreement, a service agreement, and other claims.


Commercial mediation of a dispute over a finder’s fee.


A personal favorite -- a Hatfield-and-McCoy-type dispute between two wealthy homeowners who lived adjacent to each other in a beach resort community – where we succeeded in fostering a settlement in large part because we held the mediation on-site – caucuses were held in driveways, on decks, by the side of a swimming pool, and even in the street. It took an entire day, but we signed the handwritten settlement agreement on a yellow pad at the end of an exhausting day.
